Lockport Police announce decision on Lockport Caves charges

If more information becomes available, the case may be reopened.

LOCKPORT, N.Y. — The Lockport Police Department released a statement on whether or not the Lockport Caves would be facing criminal charges after an incident in June left 1 person dead, and several injured from a boat capsizing during a tour. 

An investigation into the incident has been announced as officially completed, and after a full review alongside the Niagara County District Attorney's Office, it has been decided that there is not enough evidence to move forward to support the possibility of criminal charges.

Government officials had proposed new regulations for the attraction, and those similar in the Western New York area in June following the incident. The new regulations would allow the State Parks Department the ability to provide oversight.  

The Bill had been sponsored by Senator Rob Ortt and Assemblyman Mike Norris. Gov. Kathy Hochul also urged lawmakers to develop plans as well. 

Lockport Police said it will review more information in the future if it does become available, and the case, if necessary. 

Family members of the victim who died filed a notice of claim against multiple government agencies back in September. The claim — filed against City of Lockport, Niagara County, and the State of New York — alleges there were no safety devices for passengers or inspections on the attraction to ensure its safety.
