Orchard Park man accused of being under the influence of drugs with infant in vehicle

The infant, who is 8 months old, was not harmed and is now in a relative's care.

ORCHARD PARK, N.Y. — A man accused of being under the influence of drugs with an infant in the back seat of his vehicle was arrested on Friday in Orchard Park.

A woman called 911 at 5:47 p.m. Friday to report a stopped vehicle with the engine running, in the middle of Hobby Lane, just south of Route 20A.

Orchard Park Police officers called to the scene found an unconscious man in the driver's seat. They also noticed an infant in the back seat of the vehicle.

Officers managed to get the driver to wake up, then asked him to exit the vehicle.

"Officers noticed a powdery substance on the offender's nose, which the offender stated was from him snorting Xanax," Orchard Park Police said in a statement, announcing the arrest.

Police deemed that 34-year-old Thomas Gugino of Orchard Park was under the influence of drugs. Gugino was arrested and declined to take a blood test at the scene, police said.

The infant, who is 8 months old, was not harmed and is now in a relative's care.

Gugino was charged with one felony count of aggravated DWI with a child in the vehicle, as well as misdemeanors for DWI drugs, criminal possession of a controlled substance, and endangering the welfare of a child. He was also issued a traffic ticket for stopping/standing on a highway.

Gugino was arraigned in Orchard Park Town Court, then released, Orchard Park Police confirmed on Saturday.
