Hamburg restaurant owner sentenced after failing to pay New York State sales tax

ERIE COUNTY, N.Y. — A Town of Hamburg restaurant owner has been sentenced after failing to pay New York State sales tax over the course of four years. 

The owner of Wanakah Grill, James Rath, 60, admitted he failed to pay $40,661.63 in state sales tax between March 1, 2014 and February 28, 2018. 

Rath pleaded guilty in September to one count of attempted grand larceny in the fourth degree, a class A misdemeanor. The Erie County District Attorney's Office says Rath has since paid full restitution to the New York State Department of Taxation and Finance.

Rath was sentenced Wednesday morning to a one year conditional discharge.
