3 Attica prison guards plead guilty in assault case

WARSAW, NY - Three Attica Correctional Facility guards have avoided a trial that was scheduled to begin Monday, amid allegations they severely beat an inmate according to Wyoming County District Attorney Donald O'Geen.

The three plead guilty to misdemeanor misconduct charges, stemming from the beating of George Williams in 2011 which left the Williams with a broken shoulder and two broken legs, among other serious injuries.

Sean Warner, Keith Swack and Matthew Rademacher were scheduled to go on trial on felony charges of gang assault, after all three rejected an offer that would have them plead guilty to misdemeanor official misconduct and resign from their jobs back in January.

The three had also been charged with tampering with physical evidence and faced up to 25 years in prison if convicted at trial of the most serious charges.

Rademacher, 31, of Wyoming, Swack, 39, of Corfu and Warner, 39, of Belfast are accused of attacking Williams, who has since been released.

As a condition of their pleas, all three have submitted their letters of resignation from the Department of Corrections, according to O'Geen. "This was about getting them out of the corrections profession. That's been the goal from day one, and it's been a consistent offer from our office," he said.

A fourth corrections officer was granted immunity for his testimony before a grand jury, which lead to the indictment of the other three.
