BUFFALO, N.Y. -- Following Investigative Posts' years of reporting on Buffalo's serious lead poisoning problem, the Common Council finally passed legislation to address chipping and peeling lead paint hazards in rental units.

The new legislation requires the following:

• Landlords and property managers of rental units built before 1978 must prove that there are not any lead paint hazards by submitting a compliance letter from a licensed inspector.

• Landlords and property managers must disclose to renters that lead paint could be in the apartment if built before 1978.

• Landlords or property managers of buildings with three or more rental units can have their certificates of occupancy revoked if lead hazards exist.

• All landlords and property managers of rentals built before 1978 must allow inspectors in to check for lead hazards.

• Landlords and property owners that had lead paint hazards must attend an accredited course on how to safely renovate, repair and paint units that contain lead paint.

• Fines increased to a range of $105 to $315 for chipping and peeling paint violations on the exterior and interior of buildings.

Council President Darius Pridgen said monitoring compliance of the new rules will be ironed out by Mayor Byron Brown's administration.

"They assured us that they are putting protocols in place to make this happen," he said.
