BUFFALO, N.Y. — A father and son were both sentenced on Monday morning before a State Supreme Court Justice for fatally injuring a 25-year-old during an assault.
The father, Christopher L. Busby, 40, of Buffalo, was sentenced to five years in prison followed by five years of post-release supervision.
His son, Daiquan A. Busby, 21, of Buffalo, was sentenced to 7.5 years in prison followed by five years of post-release supervision.
On December 17, 2022, the pair were with a co-defendant, Lewis A. Keys, 24, of Buffalo, when they assaulted a victim inside an apartment building on the 100 block of Rodney Avenue in the City of Buffalo.
The victim who has been identified as Mikhail C. Scott, 25, had been repeatedly punched, kicked, and dragged down the stairs of the apartment and onto an outside sidewalk.
Scott was taken by ambulance to ECMC where he was pronounced dead due to his injuries. The Erie County Medical Examiner's Office determined that the manner of Scott's death was a homicide caused by blunt force trauma to the head.
Both the father and son had pleaded guilty to one count of murder in the first degree on separate court dates in May and June of 2024.
Their codefendant, Keys had also pleaded guilty to one count of manslaughter in the first degree for his involvement in the fatal assault.
Keys is currently serving a determinate sentence of 8 years in prison followed by 5 years post-release supervision.
