Driver of fatal rollover crash charged with vehicular manslaughter

Police say Tremayne D. Brooks, 27, of Buffalo was driving under the influence of drugs and alcohol when the crash happened.

BUFFALO, N.Y. — The Buffalo Police Department made an arrest in connection to a fatal rollover crash, which occurred on August 3.

Police say Tremayne D. Brooks, 27, of Buffalo was driving under the influence of drugs and alcohol when the crash happened.

Brooks was allegedly traveling 25 mph over the 30 mph speed limit on Memorial Drive when he drove off the road. The vehicle hit a curb, then a tree, before rolling over. Toni Abernathy, 42, was in the passenger seat and was pronounced dead on the scene.

According to police, Brooks attempted to flee the crash on foot, but fell down due to injuries sustained from the incident. He was then taken to ECMC with non-life threatening injuries.

Investigators say Brooks had a BAC of .14 at the time of the crash.

Brooks has been charged with a DWI, vehicular manslaughter, aggravated unlicensed operation of a vehicle, speeding and failure to keep right.
