BUFFALO, NY - New Mexico State Police have released a dash cam video, which captures a chase involving a Western New York man early this year, and which ended with police shooting and wounding him.

On the night of January 4, Albert Urban, 73, of Hamburg, was nearly 2,000 miles from home traveling on Interstate 25 in Northeast New Mexico…and going the wrong way.

Police say by the time they encountered him, they had received more than 100 calls from alarmed motorists.

During what would be a 17 mile chase, an officer, trailing Urban with lights and sirens, first uses his loudspeaker in an attempt to get Urban to pull over.

Police then deployed spike strips in an attempt to stop the vehicle, but despite flattening one of his tires, Urban kept going.

An officer then executed PIT maneuver, where he used his patrol car to nudge the rear bumper of Urban's vehicle, causing it to spin into the median.

Urban's van is seen careening of the expressway, rolling once, and then landing upright. Incredibly, as officers approach, the van heads straight toward them…and one opens fire.

Charged with aggravated assault on an officer, and an additional count of fleeing an officer., Urban was taken to a hospital for treatment of gunshot wounds, where he spent nearly a month according to his son.

In February, the San Miguel County District Attorney dropped all charges against Urban, after doctors determined he was suffering from dementia.

In late March the DA, who deemed the shooting justified, also cleared the officer who opened fire of wrongdoing.

Urban's son George, who politely declined an on camera interview Tuesday, told WGRZ-TV his father is back in Western New York and continues to recuperate at an assisted living center.

"He is doing as good as can be expected," said Urban, who declined to say if the family will pursue leagal action.

However, a Public Information Officer with the New Mexico State Police told us that a notice of claim had already been filed against the department, and for that reason, would not comment for our story.
