MARILLA, N.Y. - A resident who saw a vehicle leave the road and strike a mailbox without stopping stepped in and followed an erratic driver charged with Driving While Intoxicated.

New York State Police say the resident followed Andrea K. Cruse, 50, as she drove northbound on Two Rod Road in the town of Marilla. The witness called 911 while they followed the vehicle.

Cruse then pulled over on Tomarsue Road and the witness confronted her removing the keys from the car. Troopers then arrived and arrested Cruse for DWI.

Cruse was processed at the State Police station in Elma where she refused to submit to a breath test. In addition to DWI, Cruse has been charged with leaving the scene of a property damage accident, refusal to take a pre-screen test, and open container of an alcoholic beverage.

Cruse was arraigned before the Elma Town Justice and remanded to the Erie County Holiding Center on $5,000 bail.

She will appear at a later date in the Marilla Town Court.
