Family Sues Fellowship Over Son's Death

Buffalo, N.Y. - The attorney for the family of a west side child hit and killed by a daycare bus last year, announced Monday they are suing the fellowship operating the bus that hit their son and brother.

Darpan Niroula was only 10 years old when he was hit by a day care bus owned by the Greater Works Christian Fellowship. The accident happened on the night of December 1st, as he was crossing the street just a few yards from his home on Rhode Island Avenue, on the city's west side.

The family is seeking $50 million in punitive damages from Greater Works Deliverance and Philadelphia Insurance claiming the bus that hit Darpan had bad breaks.

They are also calling for a boycott of Philadelphia Insurance. "It is appalling to know that Greater Works and Philadelphia Insurance continue to deny responsibility for the accident, even after several Greater Works employees have come forward stating all parties were aware of the mechanical issues on that bus," said family attorney Frank Bogulski. "Additionally, these employees stated that they were instructed to continue to operate the vehicle putting themselves, the children they transported and the general community at great risk."

Over the weekend, Buffalo Police announced their investigation of the accident was completed. They found no evidence of criminal wrongdoing, but cited the driver for failure to use due car and unsafe brakes.

"He was really one of the best child in the family and parents loved him so much, and he was good to all the people in the community, and he has a lot of friends. So we miss him," said Bhutanese community leader Kagi Sumwar at a fundraiser held for the family earlier this year.
