BATAVIA, N.Y. -- Genesee County Sheriff Officials arrested a woman after she allegedly left 2-year-old twin sons home alone on the same night a fire claimed their lives.
Heather M. Ace, 25, was charged with two counts of Endangering the Welfare of a Child.
The charges come after officials investigated the fatal fire on May 20 in her home, located at 8157 State Street Road, Batavia.
Officials believe the fire originated either inside or near the twin toddlers' bedroom while Ace allegedly wasn't home.
Ace is accused of leaving the children alone inside her home for about an hour and a half without providing any arrangements for their supervision.
During this time, around 10 p.m., an upstairs tenant came home and saw smoke inside the residence. The tenant called 911.
The twin boys, Michael and Micah Gard, were found in their bedroom on the first floor of the multi-family residence. Sheriff officials said the twin boys died of smoke inhalation.
The cause of the fire is still under investigation.
Ace was issued tickets to answer the charges in the Town of Batavia Court Oct. 1 at 1 p.m.
The Genesee County District Attorney's Office, Genesee County Emergency Management Office and the Town of Batavia Fire Department assisted in the investigation that lead to Ace's arrest.
