Buffalo Common Councilmember Brian Davis stepped out on the steps of City Hall Wednesday evening to formally apologize for his recent actions and resign from his current position on the Buffalo Common Council.
"I would like to tender my resignation as the Ellicott District Council Member," Davis told reporters. "I can no longer allow my personal situation to be a distraction."
That personal situation came to a head last week when Davis pleaded guilty to taking campaign donations and using that money for himself.
"I accept the consequences for my actions" he said. "My conduct was not acceptable and I do want to apologize."
His resignation didn't surprise the common council president.
"I expect Mr. Davis probably anticipated an unfavorable ruling from the law department so he figured he'd do a pre-emptive strike," said David Franczyk, (D) Buffalo Common Council President.
The city law department was deciding whether Davis could keep his seat after he pleaded guilty. He wasn't automatically removed from office because the charges were misdemeanors, not felonies. Now that Davis resigned, the ball is in the council's court to choose a replacement.
"Any names on that list?" 2 On Your Side's Josh Boose asked Franczyk.
"Lots of names," Franczyk replied. "You're going to find out who they all are."
2 On Your Side found one. A source says Rev. Darius Pridgen, a popular Buffalo minister, is on the shortlist.
"He's not the only one, there are quite a few others too as well," said Franczyk.
Franczyk said the council seat opening has to be posted for at least five days before any decision is made.
2 On Your Side spoke with three other common council members Wednesday night. All of them wish Davis well but say they're going to focus on business at hand and appointing a new councilperson.
