The Niagara County Sheriffs Department has seized the work and personal cell phones of the tow truck driver involved in a Wednesday morning accident in Lockport.
The Sheriff's Department says it has probable cause to believe 25-year-old Nicholas Sparks of Burt was texting or talking on one of the phones by his own admission. According to the Sheriff's Department, speed also may have been a contributing factor.
Sparks is charged with reckless driving, talking on his cell and reckless endangerment, more charges are pending.
According to the Sheriff's Department, the tow truck rear ended a car that was turning left off of Tonawanda Creek Road onto Littlewood Road. Investigators say the tow truck was driving at a high speed, and did not attempt to stop.
When it hit the car, a few of the cars attached to the tow truck released and were sent into a nearby house. The tow truck finally stopped in an inground pool.
68-year-old Lilly White of Lockport was driving the car that was hit. She was taken to ECMC with a head injury and is in serious condition.
Her 8-year-old grand niece was in the back seat. She was taken to Women and Children's Hospital with minor injuries.
