The controversial plan to re-zone the old Buffalo Gun Club property in Amherst could be costly to the town. A Town Board Member is a party to a lawsuit against the Amherst Town Board.

Town Board Member Dan Ward cast a no vote and has joined residents ready to fight the town over re-zone the Maple Road land.

Since Ward is suing, the Town attorney can not handle the case. As a result, Dr. Barry Weinstein says "Amherst had to allocate 20 thousand dollars in taxpayer funds to defend it. We can't defend it in house because a Town Board member (Ward) has signed on with the opposition and he's basically suing the town."

A couple of months ago the Amherst Town Board voted 4-3 to approve a plan to redevelop the old gun club property on Maple Road.

Hundreds of residents turned out at Sweet Home High School to voice their opinion of the project before the board voted.

Benderson Development wants to turn the site into shops, restaurants and office space.

The board members were split 3-3 with Supervisor Satish Mohan casting the deciding vote.

Those who opposed to the site say there's enough development in the area and they don't need any more traffic. However, residents who were in favor of the plan say the plan could bring in millions of revenue for the town.
