Aide gets probation for stealing $41,590

CHEEKTOWAGA, N.Y. -- A Cheektowaga home health care aide who stole more than $41,000 from her elderly client to fuel a gambling addiction will not be spending time behind bars. 

Erie County Judge Kenneth Case sentenced 54-year-old Mary Talbot to 5 years on probation Thursday for stealing $41,590 from an 82-year-old West Seneca woman. 

In April, Talbot pleaded guilty to the charges of third-degree Grand Larceny and five counts of second-degree Forgery. 

She stole the money by writing checks to herself from her client, and the money went toward her gambling addiction. 

"She's in counseling, she had a serious gambling problem, which is a serious addiction, and she's now getting the help that she needed," said John Flynn, Erie County District Attorney. "She's being held accountable, though, for her actions."

Talbot has to pay back the money she stole, and she's repaid about half so far. She must pay the victim back $350 a month until the June 2022.
