ALBION, NY-- A 9-year-old Albion boy is recovering after he was allegedly shot by his brother.
The incident happened just before 10pm Thursday on Caroline Street in the Village of Albion.
Albion Police say the 9-year-old was accidentally shot in the arm by his 13-year-old brother with a .38 caliber gun. He was taken to Strong Memorial Hospital, and is currently in stable condition.
Investigators say the 13-year-old stole the handgun from an elderly acquaintance of the family, and was playing with the handgun in his bedroom when it went off, hitting his brother who was in his bed.
Both boys ran to a next door neighbor's home where their mother was. The children's father was in the home at the time of the shooting. Police say neither parent was aware the 13-year-old had the gun.
Police later discovered that the 13-year-old also had stolen a .22 caliber gun from the family acquaintance and had hidden it in the garage.
The 13-year-old is being charged with reckless endangerment, grand larceny and criminal possession of a weapon. He is expected to appear in court at a later date.
The Village of Albion Code Enforcement also revoked the Certificate of Occupancy at the Caroline Street address due to several serious code violations.
