Testimony Begins in Nushawn Williams Civil Trial

MAYVILLE, NY-- Nushawn Williams' civil confinement trial got underway Monday in Chautauqua County Court.  Williams, now 36, finds himself back in the place where he was labeled a sexual predator for having sex while HIV positive in the 90's.

At issue is, despite the fact that Williams has completed his prison sentence, the New York State Attorney General's Office wants to continue to keep him confined, saying, he has a mental abnormality.

The state is not commenting on camera, but say they are also prepared to refute the latest big revelation by the defense that Williams does not have HIV, the virus that causes AIDS.

"A large focus of this trial will be on the type of testing done then (in the 1990's) and how often it led to false positives. It will be hotly contested, no question about it,"  says John Nuchereno, defense attorney for Nushawn Williams.

One witness who spent the majority of the day on the stand is Dr. Jacob Hadden, who worked for the Department of Mental Health in the past.

Because this trial involves confidential medical records, the courtroom is closed to the pubic and media.  Eight men and four women will decide the case, which is expected to last one week.
