BUFFALO, NY - A Brant woman who killed a seven-month-old baby and seriously injured the baby's mother in a car crash last year will spend the next several years behind bars.
Danielle Kellogg was sentenced to 15 years in prison, the maximum sentence allowed. Kellogg pleaded guilty in March to 1st Degree Vehicular Manslaughter.
Investigators say Kellogg was traveling on Southwestern Boulevard, on the Cattaraugus Indian Reservation, when she crossed over the center line and struck another vehicle
, driven by 31-year-old Denise Hine, of Hamburg. In the vehicle with Hine was Hine's seven month old daughter Baylee M. Dion
Prosecutors said in court that Kellogg had marijuana, cocaine and alcohol in her system at the time of the crash.
Baylee Dion died from her injuries.
Although Kellogg was sentenced to 15 years, it's an indeterminate sentence, so she could be eligible for parole in 5 years; however, Erie County District Attorney Frank Sedita said, based on the parole board's history, he believes she will serve at least 10 years behind bars.
