3 Charged with Endangering a Child Following Traffic Accident

ELMA, NY -  A driver and two passengers face child endangerment charges following a traffic accident Thursday night.

Deputies say they responded to a report of a car sliding off Route 400 and a fight between the occupants of the car.

When deputies arrived, they found the occupants of the vehicle on the median of Route 400 in the snow.  A two-month-old baby was found in the car. 

They say the driver of the vehicle, Maximillian M. Mathis of Williamsville, appeared to be impaired.

Mathis was charged with Felony DWI-Drugs, a Leandra's Law violation, Endangering the Welfare of a Child and numerous traffic violations.

The parents of the infant were also charged with Endangering the Welfare of a Child. 

Deputies say Daniel Hart and Angela Mead, of Wood Avenue in Buffalo, were charged because they knowingly allowed their child to be driven by someone they knew to be under the influence of drugs. 

Everyone involved in the accident was treated at the scene, before being taken to the Sheriff's Elma substation to be processed.

The infant was turned over to a family member.  Child Protective Services has also been notified.
