AMHERST, NY - A Town of Tonawanda woman was one of two people killed Sunday while walking with her family.
Jocelyn Elberson, 25, was walking with her mother and aunt on the Amherst bike path when she was struck by a motorcyclist on Tonawanda Creek Road.
A second woman, Sheila Pelton, 81, of East Amherst, who is not connected to Elberson, was also killed. Sheila was struck by the motorcycle while walking with her husband, Foster. She was taken to Millard Fillmore Suburban where she later died.
Foster Pelton, 79, was taken to ECMC. He is currently in critical condition. His son, Nigel tells 2 On Your Side that his father has broken legs, ribs and other fractures.
Amherst Police say David Smith, 53, of Niagara Falls was driving his motorcycle west shortly before 3:30 p.m. Sunday, when he drove onto the Amherst bike path, striking Elberson and the Peltons.
Smith was also taken to ECMC with non-life threatening injuries. Smith was charged with Driving While Intoxicated and Criminally Negligent Homicide. Amherst Police obtained a court order to draw blood from Smith.
