NIAGARA FALLS, NY-- A new company is getting to work Monday on Lewiston Road in Niagara Falls.

The road repair project there has been stopped for weeks because of the lawsuits between the City of Niagara Falls and the former contractor Man O Trees.

Now that the city has won the legal fight, Accadia Contracting has been hired to finish the project.

Accadia contacted 2 On Your Side soon after they begin digging at the site and were upset at the condition the road was left in. Paul Marinaccio says that the problem lies under the other side of the road, work that was already completed by Man O' Trees.

"I have never seen anything like this ever in my life, I am absolutely stunned and shocked" said Marinaccio. He was referring to what he called inconsistencies in the base materials for the road. They range in depth anywhere from 6 to 10 inches. Accadia's contract calls for 12 inches of base. Marinaccio says in addition to concerns about how long the previous section of road will hold up, he is not sure how he is going to match the road levels between the two sides.

Marinaccio says he would recommend tearing out the road and starting over. That would cost the city of Niagara Falls millions of dollars. Marinaccio plans to call the Mayor's office on Tuesday to voice concerns and ask for guidance.
