CONCORD, N.Y. - One person was airlifted by Mercy Flight in an All-Terrain-Vehicle crash in Zoar Valley overnight.

Erie County Sheriff's Deputies say two adults and one teenager were riding separate ATV's along Zoar Valley Road in the town of Concord.

One of the riders, 49 year old Scott Smith of Collins, crashed his vehicle and was ejected. S. Smith suffered a severe leg injury and was taken by Mercy Flight to ECMC.

His brother, 47 year old Glen Smith of Lancaster, was charged with Driving While Intoxicated. G. Smith was released and will appear in town of Concord Court.

Deputies say charges may be placed against S. Smith pending an investigation and toxicology tests.
