Sen. Martin Malave Dilan, D-Brooklyn, is among plaintiffs this morning who are filing a lawsuit against Senate Republicans for creating a 63rd Senate seat during the redistricting process this year.
The lawsuit is to be filed today in state Supreme Court in Manhattan. The New York Times wrote first about the lawsuit.
The 53-page lawsuit-which includes several other plaintiffs, including Todd Breitbart, a former Democratic staffer-claims that the creation of the 63rd Senate district through the Hudson Valley is unconstitutional, saying it was created clearly for political purposes.
The Senate now has 62 seats. Republicans hold a slim 32-29 seat majority with one vacancy.
"This is blatantly unconstitutional," the lawsuit states. It adds, "There is no constitutional path that leads to a 63-seat Senate in 2012."
The lawsuit, not unexpected, will certainly complicate matters for the state Legislative Task Force on Demographic Research and Reapportionment, which is seeking to finalize the 213 legislative lines after a series of public hearings over the next several weeks.
They haven't even released the lines for the 27 U.S. House seats and the timeline for the elections this year is unlikely to be met, Gannett's Albany Bureau reported today.
