WGRZ BIGGEST LOSER RESORT NIAGARA CONTEST
OFFICIAL CONTEST RULES
1. NO
PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS
OF WINNING. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED.
2. Eligibility. Subject to the additional restrictions below, " WGRZ
Biggest Loser Resort Niagara Contest" (the "Contest") is open to legal U.S.
residents of the following counties of in the States of New York and
Pennsylvania: New York: Erie, Niagara,
Orleans, Genesee, Wyoming, Chautauqua, Cattaraugus, Allegany; Pennsylvania:
McKean and Potter, who are 18 years or older, at the time of entry. Employees
and contractors of WGRZ, ("Sponsor"), Universal City Studios Productions LLLP, Biggest
Loser Resorts, Snyder Corporation and Gannett Co., Inc., and each of their
respective affiliated companies, subsidiaries, advertising or promotional
agencies, and other agents, and the immediate family members of, and any
persons domiciled with such employees, are not eligible.
3. How to Enter. The Contest will begin at 8:00 a.m. (E.T.) on Friday,
February 10, 2012 and ends at 11:00 a.m...(E.T.) on Tuesday, April 10, 2012
(the "Contest Period"). Entries must be submitted beginning 8:00 a.m. (E.T.) February
10, 2012 and no later than 11:59 p.m. (E.T.) March 2, 2012. (the "Entry
Period").
Enter
by visiting the "WGRZ Biggest Loser Resort Niagara" official registration page
on www.wgrz.com, upload a video of the contestant explaining the reasons the Contestant
believes he/she should be selected to participate in the Contest, such as to
lose weight, improve overall health, or get back in shape after an injury and
submit all required information (name, address, phone number, and email
address). Complete all required fields on entry form and submit your entry by
clicking on the "SEND" button. The maximum length of each video is sixty (60) seconds.
Videos of longer length will be disqualified. Email files and videos submitted
directly to any Sponsor will not be accepted. Each video submission must be an
authentic, original photograph and the Contestant must own the copyright in the
video. Contestants certify that individuals other than themselves shown in the
video have been informed that the Contestant's video has been entered in a contest
and have no objection to the submission and Sponsor's display, broadcast and
posting of such video for the purposes of the Contest. All digital entries
should be at the highest resolution possible. Sponsor will accept the formats
of MOV, WMV, AVI, MP3 and or M4V. Sponsor reserves the right to disqualify or
withdraw any entry that is alleged to infringe on any third-party's
intellectual property rights, or that Sponsor deems to be obscene, offensive or
otherwise inappropriate for viewing by a general audience. Your computer must
accept cookies, or any successor or similar technology that may be used for the
purpose of entry tracking. Ad blocking software on your computer should be
disabled so that it will not interfere with processing your entry. Maximum
of one (1) entry per contestant.
All
entries become property of Sponsors and none will be returned. Contestants agree
that Sponsor shall have the right, in its sole discretion, to post any Contestant's
submitted video on Sponsor's website, www.wgrz.com,
and broadcast the winning video on WGRZ. Sponsor will not be responsible for
incomplete, lost, late, misdirected or illegible entries or for failure to
receive entries due to transmission failures or technical failures of any kind,
including, without limitation, malfunctioning of any telephone connection,
network, hardware or software, whether originating with sender or Sponsor.
4. Finalists & Winners
Selection.
Finalists. On or about
March 12, 2012, ten (10) contestants will be selected as finalists (each, a
"Finalist" and collectively, "Finalists") from all eligible entries received by
judges selected by Sponsor representatives. Each entry will be judged according
to the following criteria: 25% enthusiasm, 25% motivation, 25% need, and 25%
health issues. The ten (10) entries with the highest cumulative totals will
the Finalists. Finalists will be notified on March 12, 2012 by telephone and
e-mail.. Decisions of the judges and Sponsor shall be final and binding in all
respects. In the event of tie among the entries, the entries will be re-judged
according to the same criteria.
Winners: The Finalists's
videos will be displayed on Sponsor's web site, www.wgrz.com, for public voting. Voting Period shall commence on
or about March 13, 2012 at 8:00 a.m. and end at 11:59 a.m. on April 10, 2012. Voting
is limited to individuals by
users who are 13 years or older during the Contest
Period. Votes are to be submitted for the entry that best deserves to
win a Prize. Limit one vote per person per day per owner of an ISP account
regardless of email address. The four (4) Finalists that receive the highest percentage of eligible votes shall be the
winners. In the event of a tie, the Winner(s) will be randomly
selected from among the tied entries. Decisions of Sponsor shall be final and
binding in all respects.
5. Prizes and Odds. Each Winner will receive a prize package for a weeklong
stay at Biggest Loser Resort Niagara from Sunday, August 19, 2012 to Saturday, August
25, 2012. The Prize package includes: single occupancy ONLY, all meals, beverages,
and a fitness program consisting of the use of the resort's fitness machines,
hiking trails, aquatics facilities, customized training with a resort trainer,
circuit training, and aerobics classes (ARV: $2,695 for each prize package). Certain
restrictions and limitations may apply. Transportation is NOT included. All other expenses not specified above as part of prize
package, are the sole responsibility of each winner. Winners may not select an
alternative agenda unless approved by the Biggest Loser Resort Niagara. no
guests will be allowed to accompany Winners. Winners must agree to these days.
6. Winners Notification and
Acceptance. Winners will be notified
on or about Tuesday, April 10, 2012 at the telephone number or email address
provided on winner's entry form. Sponsor will call during regular business
hours at number provided on entry form and will leave no messages. Failure to
reach any winner by phone after three (3) attempts or failure of any winner to
respond to the email notification within 48 hours or return of the email
notification as undeliverable may result in disqualification of winner,
forfeiture of his or her interest in all prizes, and selection of a substitute
winner from among all remaining eligible entries. The Winners' names
will be announced live on Sponsor's program "2 News Daybreak" on April 11,
2012. Return of email
prize notification as undeliverable may result in disqualification and an
alternate winner may be selected. The identity of the winners will be also be
announced on Sponsor's "2 News Daybreak" program on Wednesday, April 11, 2012
between 5:00 a.m. (E.T.) and 7:00 a.m. (E.T.). To claim prize, each winner
must personally visit Sponsor's offices at 259 Delaware Avenue, Buffalo, New
York, 14202 within (5) business days after notification (office visits
must be between the hours of 9:00 a.m. (E.T.) and 5:00 p.m. (E.T.) weekdays)
and must present a valid photo identification. The Biggest Loser Resort
Niagara will contact each Winner directly to make arrangements to redeem the
prize package. Any winners may waive his/her right to receive the prize. The prize
is non-assignable and nontransferable. No substitutions allowed, except that
prizes and individual components of Prize package is subject to availability
and Sponsors reserve the right to substitute prizes of equal or greater value. Prizes are not redeemable for cash. Winners are solely responsible for reporting and
payment of any taxes on prizes. Winners may be required to complete an
affidavit of eligibility, a medical release, and a liability and publicity
release which must be returned within twenty-four (24) hours after receipt.
Failure to complete, sign and return the affidavit or releases within 24 hours,
or to comply with any term or condition of these Official Rules, may result in such
winner's disqualification, the forfeiture of his or her interest in the prize,
and the award of the prize to an alternate winner. Except where prohibited,
participation in the Contest constitutes Contestants' consent to the
publication of his or her name, biographical information and likeness in any
media for any commercial or promotional purpose, without limitation or further
compensation. Prizes not won and claimed by eligible winners in accordance
with these Official Rules will not be awarded and will remain the property of
Sponsor.
7. Participation.
By participating, Contestants agree to be bound by these Official Rules and the
decisions of the judges. Sponsors reserve the right to disqualify persons
found tampering with or otherwise abusing any aspect of this Contest as solely
determined by Sponsors. In the event the Contest is compromised by a virus,
non-authorized human intervention, tampering or other causes beyond the
reasonable control of Sponsor which corrupts or impairs the administration,
security, fairness or proper operation of the Contest, Sponsors reserve the
right in its sole discretion to suspend, modify or terminate the Contest, or
repeat the Contest. Should the Contest be terminated prior to the stated
expiration date, Sponsors reserve the right to award prizes based on the
entries received before the termination date. Gannett Co., Inc. and their
respective affiliates and subsidiaries and their respective directors,
officers, employees, agents, successors and assigns are not responsible for any
illness or injury which may result from participation in this Contest. Sponsors
will not be responsible for incomplete, lost, late, postage-due, misdirected or
illegible entries, poor quality photos, or for failure to receive entries or
other electronic communications due to transmission failures or technical
failures of any kind, including, without limitation, malfunctioning of any
network, hardware or software, whether originating with sender or Sponsor. In
the event of a dispute, all online entries will be deemed to have been
submitted by the owner of the ISP account from which they were sent. For these
purposes, an ISP account holder shall mean the natural person assigned to such
ISP account by the Internet access provider, online service provider or other
organization responsible for assigning ISP addresses for the domain associated
with such ISP account. Any questions regarding the number of entries or the
owner of an ISP account shall be determined by Sponsors in its sole discretion.
Sponsor is not responsible for the operation of the Biggest Loser Resort
Niagara, including schedule changes or closings.
8. Copyright.
By entering the Contest, each Contestant grants to Sponsors an exclusive,
royalty-free and irrevocable right and license to publish, print, edit or
otherwise use the Contestant's submitted entry, (including photos, narrative,
and video) in whole or in part, for any purpose and in any manner or media
(including, without limitation, the Internet) throughout the world in
perpetuity, and to license others to do so, all without limitation or further
compensation.
9. Construction.
All issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and obligations of
any Contestant and Sponsors, shall be governed by, and construed in accordance
with the laws of the State of New York, without giving effect to any choice of
law or conflict of law rules or provisions (whether of New York, or any other
jurisdiction) that would cause the application of the laws of any jurisdiction
other than New York. The invalidity or unenforceability of any provision of
these rules shall not affect the validity or enforceability of any other
provision. If any such provision is determined to be invalid or otherwise
unenforceable, these rules shall be construed in accordance with their terms as
if the valid or enforceable provision was not contained therein.
10. General
Release. By entering the Contest, Contestants release WGRZ, Gannett
Co., Inc., The Biggest Loser Resorts, NBC Universal Media, LLC, the Snyder
Corporation, participating advertisers, any other promotional sponsors, and
each of their respective affiliated companies, directors, officers, employees,
representatives, partners and agents from any liability whatsoever for any
claims, costs, injuries, medical complications or risks, losses or damages of
any kind arising out of or in connection with their participation in the
Contest, the Contest, or with the acceptance, possession or use of any service
or prize (including, without limitation, claims, costs, injuries, losses or
damages related to personal injuries, death, damage to, loss or destruction of
property, rights of publicity or privacy, defamation or portrayal in a false
light).
11. Sponsors. The WGRZ Biggest Loser Resort Niagara contest is sponsored by WGRZ, whose
decisions regarding the selection of winners and all other aspects of the
Contest shall be final and binding in all respects. Sponsor will not be
responsible for typographical, printing or other inadvertent errors in these
Official Rules or in other materials relating to the Contest. For a list of
