OFFICIAL RULES

SECOND CHANCE CONTEST MAY 2008

1.   NO PURCHASE NECESSARY TO ENTER OR TO WIN.  A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING.  ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

  1. Eligibility.  The Second Chance Contest(the “Contest”) is open to U.S. residents (excluding Puerto Rico), residents of the state of New York ,18 years or older at the time of entry that are holders of any New York Lottery ticket on sale or open for redemption at the time of the promotion from April 21st – May 25, 2008.  Employees of WGRZ, Gannett Co., Inc., The New York Lottery, DDB New York and Tim Horton’s and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees, are not eligible.
  1. Entry.  The Contest runs Monday, April 21, 2008 thru May 25, 2008 and all entries must be received by Friday, May16, 2008 by 10am EST.
  1. Mail Entry:  To enter the Second Chance Contest, mail any non-winning New York Lottery ticket on sale or open for redemption at the time of the promotion from 4/21/2008-5/25/2008, along with your name, address and phone number to the address below.  All entries must be sent in a white envelope no larger than a #10 business envelope with first class postage affixed.  Envelopes must be postmarked in New York State.  Limit one entry per envelope.  No bulk mailings will be accepted.  Final entry deadline is 10:00am Friday, May16, 2008.  Entries are not valid for other promotional offers.  Send entries to:

Watch and Win:  A random drawing will be held on these Fridays: April 19th,26th, and Mary 3rd, 10th, & 17th,  to draw winners for the following seven weekdays.  One winner will be announced each weekday from Monday, April 21, 2008 through Sunday, May 25, 2008 during WGRZ-TV’s Daybreak morning show (5:00am-7:00am EST) and Daybreak Saturday Morning (9am-11:30am, Sunday 7-8am).   A total of 35 names will be announced, one per day for the length of the contest.  The announced winner has 22 minutes after their name is announced to call into the station and win $222 worth of instant game tickets and a certificate at Tim Horton’s. There will be a maximum of 35 winners.  Entrants may only win once during the contest period.   All non-selected entries will carry over from drawing to drawing.  Enter by watching Channel 2 News Daybreak on WGRZ-TV between April 21st – May 25, 2008 between 5-7am Mon-Fri, 9-1030a on Saturdays and Sundays 7-8am.    After WGRZ broadcasts the “call now” announcement, the entrant’s whose name was called has 22 minutes to call 716-849-2200 to become a winner, provided that the caller meets the eligibility requirements stated in these Official Rules.  If that entrant does not call within the 22 minute window, WGRZ-TV has the right to not award that day’s prize.

You may enter the Contest as often as you like but only one (1) prize per person during the contest period and only one entry per envelope.

WGRZ, The New York Lottery, DDB New York and Tim Horton’s  (“collectively referred to as Sponsor’)” will not be responsible for incomplete, lost, late, (past the Final entry deadline of 10:00am  EST on Friday, May 16, 2008) misdirected or illegible entries.   Entries received become the sole property of the New York Lottery.  None will be returned.   Any ticket mechanically reproduced, altered, mutilated, tampered with in any way, containing any printing or other errors or not received through legitimate channels is null and void.  Be sure your ticket has not already won a New York Lottery prize prior to entering the Sweepstakes.  The New York Lottery will not be responsible for entrants mailing a winning Lottery ticket. Lotto subscribers are not automatically entered into the promotion.  Any entries that do not have all the requested information filled out completely or those that are filled out illegibly will be disqualified.

4. Prizes and Odds.  Each week there could be the potential of 7 winners (1 per day) each winning 111 instant game tickets ($222 total per winner) and a certificate at Tim Horton’s.  One winner announced per day from Monday, April 21st ,   through Sunday, May 25, 2008.

Prize value: $222 each, maximum total weekly prize value is $1,554 Hot 5’s tickets and $10 each, maximum total weekly prize value is $84 for Tim Horton lunches.

Odds of winning depend on the number of eligible entries received based upon the random drawings.

5.         Winner Notification and Acceptance

To claim the prize, each winner must follow the call-in process identified above and must  personally visit WGRZ-TV, 259 Delaware Avenue, Buffalo, NY 14202 during normal business hours (9:00am-5:00pm Monday-Friday) to claim their prizes.  All Federal, state and local laws and regulations apply.  Taxes are the sole responsibility of winners.  No cash substitutions or transfer of prizes permitted.  Winners are required to sign a claim form in order to collect their prize.  Winners not able to claim their prize in person must sign and return a claim form to WGRZ-TV and provide a New York State mailing address before receiving prize.  By acceptance of prize, winner agrees to use of their name, and/or likeness for purposes of advertising or trade without further compensation. Winners agree that the New York Lottery, its agents and employees shall not be liable for injury, loss or damage of any kind resulting from acceptance or use of the prize awarded.

Winners may waive their right to receive prizes.  Prizes are nonassignable and nontransferable.  No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value.  Winners are solely responsible for reporting and payment of any taxes on prizes.  Winners will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark.  Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner.  Except where prohibited, participation in the Contest constitutes entrant’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation.  Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor.  For names of contest winners, send a self-addressed, stamped #10 envelope to: New York Lottery, 165 Genesee Street, Buffalo, New York , Attn: Promotions Manager.

6.         Participation.  By participating, entrants agree to be bound by these Official Rules and the decisions of the judges.  Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor.  Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.

7.         Limitations of Liability.  By entering the Contest, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

8.         Construction.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than New York State.   The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein.

9.         General Release.  By entering the Contest, contestants release WGRZ, Gannett Co., Inc., the New York Lottery, DDB New York and Tim Horton’s and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

10.       Sponsor.  The Second Chance Contest is sponsored by WGRZ, Gannett Co., Inc., the New York Lottery, DDB New York and Tim Horton’s, whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects.  Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.  If you have any questions regarding this Contest, please contact David Luka, WGRZ-TV, 259 Delaware Avenue, Buffalo, New York, 14202.
