BUFFALO, N.Y. -- There is a new development in a bribery case against long-time political operative Steve Pigeon.
Some key evidence has been tossed-out.
A source knowledgeable of this case tells 2 On Your Side that judge Donald Cerio has granted a defense motion to throw out emails which were a substantial part of the prosecution's case.
About a year ago, then-supreme court judge John Michalek resigned from the bench, and pled guilty to charges in which he acknowledged was a favor-swapping scheme with Pigeon.
Much of the most incriminating evidence were emails between Michalek and Pigeon. Without the emails, it is unclear how the attorney general's office can go forward with this case.
