EDEN, N.Y. - An Eden man is in jail after his mother was found dead in the home they shared.

Eden Police say they were called to 8925 East Eden Road just before 4 p.m. Thursday for a report of a person shot.  There, they found Mary Kozak, 79, shot to death.  The caller also said Kozak was a potential suspect, though officials wouldn't say who made the call.

A few hours later, Pennsylvania State Police found Wayne Kozak, 48, hiding in a motel in Erie, Pennsylvania.  

He was arrested on a fugitive warrant and arraigned in court.  Police say he was arrested without incident.  They said he did not have any weapons on him when he was arrested.  

Kozak is currently in a Pennsylvania jail without bail.  An extradition hearing will be held to return him to Western New York to face a second-degree murder charge.

There's no word on a motive for the shooting.  

Police wouldn't say if Kozak had a prior criminal history, but they said there were never any previous incidents at the home that involved police.

Erie County District Attorney John Flynn wouldn't say if the murder weapon was found or comment on what type of gun was used in the killing.  He also didn't say if there were signs of a struggle.

Flynn said Kozak and his mother were the only two people who lived at the home.  He said the younger Kozak was single and doesn't have any children.
