BUFFALO, NY – A Box Street man will spend the next 15 years in prison after admitting to severely injuring a toddler he was left to babysit last fall.
Marcell Brooks, 25, plead guilty to a single count of Assault in the First Degree in connection with an attack on Devyn Grabowski in October, when Devyn was 22 months old
“I’m glad it’s done and over with. Justice has finally been served,” said Jeff Grabowski, Devyn’s father, who spoke with WGRZ-TV outside a State Supreme Courtroom where Brooks entered his guilty plea on Tuesday morning, and will return for sentencing on July 28.
According to Grabowski, Devyn had been sent on a scheduled weekend visit with his mother, from whom Grabowski is estranged.
She left Devyn in the care of her sister, who then went to work and left Devyn with Brooks, who was the woman’s boyfriend.
Grabowski said he later received a phone advising him that his son had been “injured” and taken to the hospital.
Doctors reported their suspicions that Devyn's brain injury, and the five fractures to his back, weren't caused by a fall down a few stairs as they had been told.
Police began looking for Brooks, and arrested him three months later.
“I’m grateful that there is closure in the case and everybody can go on about their life, and nobody will have to worry about him (Brooks) doing this to somebody else for a while,” said Grabowski.
Meanwhile Devyn, who will turn three in December and who at one point has been on life support, continues in his recovery.
“Devyn’s got a long road ahead of him but he is making progress slowly but surely,” said his father.
“He’s just now starting to use his legs and his hand. He does have some vision, but we’re not exactly sure just much yet. They are working on getting him into a schooling program for special needs...we’re not sure if he’s gonna make a full recovery, so basically we’re just going day by day with him, and doing all his therapies and stuff that needs to be done,” Grabowski said.
